Terms of Service

1. Who we are

ColliderOS is operated by Kaizen Collider LLC, a limited liability company organized under the laws of the State of Texas ("Kaizen Collider," "we," "us"). These Terms govern your use of ColliderOS and any related services (the "Service").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Who may use the Service

You must be at least 18 years old. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" includes that organization.

3. Your account

You are responsible for your account credentials and for activity under your account. Tell us promptly at ryan@kaizencollider.com if you believe your account has been accessed without your authorization.

One account is for one person. Do not share credentials.

4. What the Service is — and is not

ColliderOS is a leadership practice tool. It helps you record commitments, hold an operating rhythm, and reflect on your own leadership work, with AI-generated coaching prompts and observations.

The Service does not provide professional advice. Coaching output is generated by an AI model, may be inaccurate, and is not legal, financial, medical, psychological, employment, or human-resources advice. You are responsible for your own decisions. Do not rely on the Service as the basis for any decision that affects someone's employment, safety, health, or legal rights.

We do not guarantee outcomes. No representation is made that using the Service will improve any business or personal result.

5. Your content

You keep ownership of everything you enter — commitments, reflections, objectives, priorities, notes, and any other content ("Your Content").

You grant us a limited licence to store, process, and transmit Your Content solely to operate and provide the Service to you, including sending it to our AI provider to generate your coaching responses. That licence exists only to run the Service and ends when you delete the content or your account.

We do not use Your Content to train AI models, and we do not permit our AI providers to do so.

We do not sell Your Content or your personal information.

6. Acceptable use

Do not:

  • use the Service to break the law, or to help anyone else do so;
  • upload content you have no right to share, including someone else's confidential or personal information;
  • attempt to access another user's account or data;
  • probe, scan, or test the security of the Service without our written permission;
  • scrape, resell, or redistribute the Service or its output as a competing product;
  • use the Service to generate content that harasses, defames, or discriminates.

A note on the second point, because it matters for this product specifically: ColliderOS captures your leadership practice. Take care before entering another person's performance details, health information, or other sensitive personal data about someone who has not agreed to it.

7. Subscriptions, billing, and renewal

Trial. New accounts may receive a free trial period. No payment method is required during the trial. At the end of the trial, access to certain features ends unless you subscribe.

Pricing. Subscriptions are offered at the prices shown at checkout. Current pricing is $99 per month, or $990 per year. We may change prices, but a change will not affect your current billing period; we will give you notice before a change applies to a renewal.

Automatic renewal. Subscriptions renew automatically at the end of each billing period at the then-current price, until cancelled. You authorize us to charge your payment method on each renewal.

Cancellation. You may cancel at any time. Cancellation takes effect at the end of the current billing period. You keep access until then. We do not pro-rate partial periods except as described in the Refund Policy.

Failed payments. If a payment fails, we may retry it and may suspend access until payment succeeds.

Payment processing. Payments are processed by Stripe. We never receive or store your full card number. Your use of Stripe is subject to Stripe's own terms.

Taxes. Prices exclude taxes unless stated otherwise. You are responsible for any applicable taxes, and we will collect them where we are required to.

8. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms.

9. Beta and changing features

ColliderOS is under active development. Features may change, be added, or be removed. Some features may be labelled early access or beta and may be less reliable. We will not remove a material feature you are paying for without notice.

10. Availability

We aim to keep the Service available but do not guarantee uninterrupted access. We may suspend the Service for maintenance, security, or reasons outside our control.

11. Suspension and termination

You may stop using the Service and delete your account at any time.

We may suspend or terminate your account if you materially breach these Terms, if required by law, or if your use creates risk or legal exposure for us or another user. Where practical, we will tell you first and give you an opportunity to fix the problem.

On termination, you may request an export of Your Content for 30 days, after which we may delete it.

12. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of liability

To the fullest extent permitted by law, Kaizen Collider will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or business opportunities.

Our total liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred US dollars.

14. Disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Bandera County, Texas, and each party consents to the personal jurisdiction of those courts.

Before filing anything, email us at ryan@kaizencollider.com and give us 30 days to resolve it.

15. Changes to these Terms

We may update these Terms. If a change is material, we will give notice — by email or in the Service — before it takes effect. Continuing to use the Service after the effective date means you accept the updated Terms.
